1. Data Controller

The controller responsible for the personal data collected through this website is Alan Gabriel Sebastian Cruz Argañaraz, operating under the trade name AGC Web Studio, based in Barcelona, Spain.

2. Data We Collect

Through the contact form we collect the following data, which you provide voluntarily:

  • Name.
  • Business or project.
  • The need you describe (what you'd like to improve or ask about).
  • Service of interest (the service category you select).
  • Contact email or phone number.
  • Explicit consent to the processing of this data, recorded together with the date the form was submitted.

We do not request special categories of data. Please do not include sensitive information in the form.

3. Purpose of Processing

Your data is used exclusively to:

  • Respond to your inquiry or request for information.
  • Evaluate and, where applicable, manage a possible proposal or business relationship with you.
  • Keep a record of communications needed to follow up on your request.

4. No Profiling, Automated Decisions, or Direct Marketing

We do not build profiles or make automated decisions that produce legal effects or significantly affect you. Nor do we use your data for direct marketing or to send unsolicited commercial communications.

5. Legal Basis

The processing of your data is based on:

  • Your consent, given by checking the corresponding box and voluntarily submitting the contact form (art. 6.1.a GDPR).
  • The performance of pre-contractual steps taken at your request, when your inquiry is aimed at exploring a possible project or quote (art. 6.1.b GDPR).

You can withdraw your consent at any time, without affecting the lawfulness of processing carried out before its withdrawal.

6. Data Retention

If no business relationship is established, we will keep your data for a maximum of 12 months from the date the form was submitted, after which it will be deleted or anonymized.

If a business relationship is established, your data will be kept for as long as that relationship lasts and, afterward, for whatever legal retention periods apply (for example, tax or accounting obligations).

7. Service Providers and Data Processors

This website is hosted on Cloudflare, Inc., which also hosts the program (Cloudflare Workers) that technically processes contact form submissions, under its Data Processing Addendum.

The notification email sent to alan@agcwebstudio.com is delivered through Resend (operated by Plus Five Five, Inc.), which acts as a data processor for that delivery, under its own Data Processing Addendum.

Both Cloudflare and Resend may process data on servers located outside the European Economic Area (Resend states that its primary processing takes place in the United States). In both cases, the transfer is covered by the Standard Contractual Clauses approved by the European Commission and, where applicable, by the EU-U.S. Data Privacy Framework.

8. Contact via WhatsApp

If you'd rather contact us through WhatsApp instead of the site's form, that communication takes place through a third-party platform (WhatsApp Ireland Limited, part of Meta). In that case, your data will also be subject to that service's own privacy policy, available at whatsapp.com/legal/privacy-policy.

9. Local Storage in the Recursos Solidaris Project

The conceptual proposal "Recursos Solidaris," included in this site's Projects section, uses the browser's local storage (localStorage) solely to remember the language you chose (Catalan or Spanish) between visits. This storage is strictly functional: it is not used for tracking, advertising, or profiling, and it is not shared with third parties.

10. Your Rights

You have the right to:

  • Access your personal data.
  • Rectify inaccurate data.
  • Erase your data once it is no longer needed.
  • Restrict or object to processing in certain circumstances.
  • Data portability, when the applicable legal requirements are met.

You can exercise these rights by writing to alan@agcwebstudio.com, stating which right you wish to exercise and providing the information needed to identify your request.

If you believe that the processing of your data does not comply with applicable regulations, you have the right to file a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, AEPD): aepd.es.
